I. Procedural History

Defendant Jyree Dominic Noel was tried before a jury on charges of (1) assault on a government official, (2) malicious conduct by a prisoner, (3) resisting, obstructing, and delaying an officer, and (4) littering. Upon motion by Defendant at the close of the State’s evidence, the trial court dismissed the charges of resisting, obstructing, and delaying an officer, and littering.
