There is no dispute as to the facts of this case. The Edward Thompson Company, appellant, is a New York State corporation engaged in the publication of law books. Charles L. Hunt, appellee, is a practicing attorney of St. Charles, Illinois. August 8, 1917, a traveling salesman of appellant solicited appellee for a contract for the sale of American & English Annotated cases. After some conversation appellant’s salesman filled out and presented to appellee two papers which purported to be duplicate contracts, owe to be retained by appellee and the other to be sent to appellant.
