The plaintiff, Fred Murray, commenced this action in the circuit court of McLean County against the defendants, Edmund A. Behrendt and Dan Carmody, seeking to be adjudged the owner of an undivided one-half interest in 320 acres of land near Artesia, New Mexico. Behrendt is the owner of record of the real estate involved. Carmody, a former partner of plaintiff, filed a disclaimer of any interest in the property. The cause was heard before the chancellor, who found for plaintiff and entered a decree ordering Behrendt to execute and deliver to plaintiff a deed to an undivided one-half interest…
