This matter comes before the Court on defendants’ motion for attorneys’ fees. Plaintiff filed this action on March 15, 1995 alleging that defendants violated his rights under the Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. § 621, et seq. Defendants moved to dismiss or in the alternative for summary judgment on the ground that plaintiff did not timely file a charge with the Equal Employment Opportunity Com*85mission (“EEOC”).
