—Christopher and Brenda Tremmel, husband and wife, appeal a summary judgment order dismissing their complaint by which they sought a judicial declaration that Safeco Insurance Company owed them a duty to defend and cover damages resulting from an automobile accident in which Mr. Tremmel was involved. We find no error and affirm the summary judgment of dismissal.

On August 12, 1982, Safeco issued an automobile liability policy to the Tremmels and received the initial premium payment on August 17. Safeco did not receive the second premium which was due on October 21. Accordingly, on…
