HANFORD, District Judge.

This is a suit in rem against the British ship Troop by Albert Louie, a German sailor, to recover compensation for excessive and unnecessary suffering after a personal injury and permanent disablement caused by falling from the main upper topsail yardarm of the ship while he was performing his duties as a member of the crew of said ship. The injuries were very severe, the bones of his left arm and right thigh being fractured, and he was otherwise cut and bruised.
