CAVE, Judge.

This is an action for damages for personal injuries in which the plaintiff obtained a verdict and judgment for $3,200, and defendant perfected its appeal.

The petition alleges that on March 9, 1952, while planitiff was walking along Greystone Boulevard, a public street in Kansas City, Kansas, and in the immediate vicinity of defendant’s plant, he was badly injured, due to the negligence of the defendant when a heavy fog of noxious and poisonous gas emanated from said plant and covered the immediate area where plaintiff was walking; that by reason of breathing and inhaling said gas,…
