I. INTRODUCTION
On December 1, 2005, James J. Joseph (“Plaintiff’), the chapter 7 trustee, commenced an adversary proceeding against Eva Madray (“Defendant”) to recover the value of Donald J. Bran’s (“Debtor”) interest in real property located at 356 “Y” Place, Laguna Beach, California (the “Property”).
