(After stating the foregoing facts.) The defendant in error contends that the bill of exceptions should be dismissed on the ground that it contains no valid assignment of error, and that the rule as to assignments of error in a direct bill of exceptions applies in view of the fact that the verdict was demanded by the evidence and the only alleged errors insisted on are the disallowance of the plaintiff’s amendments and the sustaining of the general demurrers thereto, and it does not appear in the bill of exceptions that the “verdict necessarily has been controlled by” such antecedent rulings.…
