Reversing.

On April 24,1914, the appellee (whom we shall hereafter refer to as plaintiff), was working as a fireman' on a locomotive engine’for the appellant (whom wé shall hereafter refer to "as defendant), and had been working in that capacity for more than two years. A train upon which he was to make a trip as fireman was due to depart from the city of Louisville at 8:15 p. m; on that day for a trip terminating at Howell, Ind.
