MEMORANDUM OPINION

This matter comes before the Court upon Motion by Lead Plaintiff, the Long View Collective Investment Fund (“Plaintiff’), for leave to file a Third Amended Class Action Complaint. By way of background, Plaintiff originally sought to include certain newly-identified statements (“the statements”) in the “Contested Facts” section of the Joint *223Final Pretrial Order (“FPO”).
