For convenience the parties hereto will be referred to as plaintiff and defendant, as they appeared in the trial court. This suit was instituted in the district court of Hughes county, Okla., by the plaintiff, R. E. Garrett, against the defendant, the Western Union Telegraph Company, for failure of said defendant to deliver to him a telegram sent to him by his brother on the 19th day of December, 1910, from Monroe, Okla., to Calvin, Okla., which read as follows:
