MEMORANDUM AND ORDER
SAFFELS, District Judge.
This matter is before the court on plaintiffs Motion for an Award of Costs and Attorneys’ Fees (Doc. 288). In accordance with the local rules, plaintiff has filed an appropriate Statement of Consultation (Doc. 810) notifying the court of the parties’ inability to reach an agreement regarding the fee award. D. Kan. Rule 54.2. Plaintiff, therefore, subsequently filed a Memorandum in Support (Doc. 309) of his motion. Defendant has since filed a Response (Doc. 316), and plaintiff has filed a Reply (Doc. 318).
