I. It is alleged that-the trial court erred in ruling that the burden of proof was on the defendants in error, plaintiffs below, and giving them the opening and clos-^ ing argument. Upon the petition, answer and reply thereto, the single issue presented was, whether plaintiff in error was legally married to Daniel P. Baughman, and therefore, as his widow, legally entitled to inherit his property. (Baughman v. Baughman, 29 Kas. 283.)
