Before the court is plaintiff Titan Indemnity Company’s motion for summary judgment against defendants City of Brandon, Mississippi, and Bruce Kirby pursuant to Rule 56(a) of the Federal Rules of Civil Procedure. 1 Plaintiff Titan Indemnity Company is the insurer of defendants pursuant to the provisions of a law enforcement liability insurance policy.
