Plaintiff Sundgren went to see his neighbor Stevens about helping fix a fence between their farms, which adjoined. Stevens and his son were in *155the feed lot. It was just at dusk. Stevens claimed that plaintiff had told him he would not stand by some arrangement he had made, to which plaintiff replied that he did not do that, that he never backed out, to which Stevens replied that plaintiff was calling him a liar (which plaintiff denied), and jerked a whip from a huggy, but did not strike.
