In this liquidation proceeding of Midland Insurance Company, certain policyholders seek a determination of the law that governs the interpretation of their policies. In denying the policyholders’ claims, the liquidator applied New York law to the interpretation of their policies. The liquidator believes that the Appellate Division held in Matter of Midland Ins. Co. (269 AD2d 50 [1st Dept 2000]) that New York law applies to all Midland creditors. The policyholders disagree, arguing that the liquidator should have used the “grouping of contacts”…
