RUARK, Judge.
This appeal comes from an order quashing an execution issued to enforce collection of delinquent installments of a judgment for child maintenance. The main issue was whether respondent should be credited with certain payments made directly to the child.
At the outset we are met with respondent’s contention (made in his brief and not by motion) that the appeal should be dismissed for failure to comply with Supreme Court Rule 1.08, 42 V.A.M.S., in that appellant’s brief does not contain a fair and concise statement of the facts relative to the questions presented for determination,…
