OPINION

RUSSELL, District Judge.

Plaintiff brought this in rem maritime action against the BRADLEY T for personal injuries sustained while working aboard that vessel. Tolen Marine, Inc. (“Tolen”), as owner of the vessel, has moved for summary judgment. For the following reasons, the motion is denied.

BACKGROUND

Gammill was employed by Merchants Transportation, Inc. (“Merchants”) as a deckhand aboard the ALABAMA MERCHANT, also known as the STANTON K. SMITH. In December of 1989 Gammill was injured while attempting to secure a lead wire on the vessel. Plaintiff alleges that the wire came loose and…
