At the close of the evidence, defendant moved for a directed verdict, assigning reasons therefor in thirteen different clauses. But it is not necessary to notice particularly all these clauses, since the three following involve substantially all questions of law presented by the exception to the overruling of the motion: (1) the road commissioner could not bind the town by a contract such as the plaintiff’s evidence tended to show, (meaning, we suppose, that part by which the horses were to be returned in as good condition as when taken); (2) the road commissioner could not bind the town by…
