Appellant brought this suit to contest a local option election held in Freestone county to determine whether or not the sale of beer containing alcohol not exceeding four (4%) per centum by weight shall be prohibited in said county, under the provisions of Article 666—40, section (a), as amended, Penal Code, Vernon’s Annotated Criminal Statutes, said contest having been filed under the provisions of Article 666— 40a, as amended, Penal Code, Vernon’s Annotated Criminal Statutes.
