John Phillips sued Kaiser Aluminum & Chemical Corporation, alleging that Kaiser failed to provide a safe workplace. Part of his claim was dismissed by an order granting partial summary judgment, and part was dismissed following a jury verdict for the defense. Because the appeal deals primarily with the order granting partial summary judgment, we view the facts in the light most favorable to the Plaintiff.
