This claim has been filed to recover damages for the alleged breach by the state of a highway construction contract. Claimant is a contractor and in the year 1916 entered into an agreement in writing with the state, pursuant to the provisions of the Highway Law, for the construction of the Elmira-North Elmira County Highway No. 1378, four and fourteen one-hundredths miles in length, in the county of Chemung.
