Appellant, Richard L. Fuqua, filed this malicious prosecution suit in state court against appellees, Thomas Graber, an attorney, and Graber’s law firm, Hopkins and Sutter. Fuqua contends that appel-lees, acting on behalf of a client, Sunbelt Savings, wrongfully filed an adversary proceeding in Fuqua’s then-pending bankruptcy case. Appellees filed a plea to the jurisdiction, contending that because Fu-qua’s claim is premised on an adversary proceeding in a bankruptcy case, it is preempted by federal bankruptcy law.
