On the 8th day of September, 1906, Orestes U. Bean and Albert H. Flint entered into an agreement whereby Bean agreed to sell and deliver to Flint on that day forty-three shares of stock of the International Smokeless Furnace Company for the sum of $30,000, payable in installments, and Flint agreed to *151accept the stock and pay for the same as in said contract provided.
