for the Court.

¶ 1. Sharon Trigg Spann filed a negligence lawsuit against the City of Jackson and Mary Jenkins in the Circuit Court of the First Judicial District of Hinds County. Before trial, Spann settled with Jenkins, leaving the City as the sole defendant. Following a non-jury trial, the circuit judge awarded Spann $285,595.52 in damages. Both parties agreed to a setoff of $25,000, which reflected the amount of the pre-trial settlement with Jenkins.
