MICHOL O’CONNOR, Justice.

Mincron SBC Corporation, the defendant below and appellant here, appeals from a summary judgment rendered in favor of WorldCom, Inc., the plaintiff below and appellee here. We reverse and remand.

Factual Background

Mincron is a small, privately-held company that developed and licensed a computer software program. Mincron incurs significant long-distance telephone charges in answering customer questions and servicing this software.
