MEMORANDUM

SIRICA, District Judge.

This matter is before the Court on the motion of the defendant, the Richmond, Fredericksburg and Potomac Railroad Com pany (Richmond) for summary judgment. The underlying cause of action has been brought by the plaintiff, Fairchild and Company, Inc. (Fairchild), to vacate an arbitration award rendered in connection with a dispute between the parties over a leasing agreement. Richmond, having counterclaimed to secure confirmation of the award and judgment thereon, now moves for summary judgment.
