Defendant appeals from a judgment of conviction of murder in the second degree and from an order denying his motion for a new trial.

Very briefly, from the evidence adduced at the trial, it appears that defendant had charge of the growing of a crop of lettuce on a large ranch belonging to a man named Victor R. Sterling, who was receiving financial assistance in the enterprise from one John B. Hager, in whose employ was a man by the name of William R. Thornberg.
