*645In a proceeding pursuant to CPLR article 75 to permanently stay arbitration of a claim for uninsured motorist benefits, the petitioner appeals from an order of the Supreme Court, Suffolk County (Cohalan, J.), dated June 10, 2009, which, after a framed-issue hearing, denied the petition and dismissed the proceeding.

Ordered that the order is affirmed, with one bill of costs to the respondents-respondents appearing separately and filing separate briefs.
