OPINION AND ORDER
LAFFITTE, Chief Judge.
Before the Court is Defendant K-Mart, Inc.’s motion to dismiss this claim on res judicata grounds. Plaintiff Maria Marcano Arroyo (“Marcano”) works at a K-Mart store in Juana Diaz, Puerto Rico. She brings this action under the Age Discrimination in Employment Act of 1967 (“ADEA”). 1 She alleges that she is over fifty years of age; that she was transferred from a position in which she was in charge of the store’s clerical organization to a position in the store’s warehouse; and that her former position in the clerical office was filled by a “young woman.”…
