DAVISON, Justice.

This is an appeal by George Nixon, et al, County Commissioners of Caddo County, Oklahoma (defendants below) from a judgment in favor of Theodore P. Roberts, County Attorney of said county (plaintiff below) granting a writ of mandamus requiring the defendants to approve and allow claims filed with them by the Assistant County Attorney (Virgil Upchurch) on the basis and to the extent of sixty percent (60%) of the County Attorney’s salary, for services rendered by the Assistant County Attorney, beginning July 1, 1965.
