This suit was instituted by appellee, J. W. Burton, for the recovery of damages from appellant, the city of Ft. Worth, on account of the overflow and submerging of a portion of appellee's lands lying contiguous to the West fork of the Trinity river, caused by the construction of a dam across said river about two miles south of appellee's said lands. Said dam was erected for the purpose of constructing a reservior, known as Lake Worth, and it was alleged by plaintiff that, by reason thereof, the water which had previously drained away from appellee's said lands was caused to back up on, and…
