SOBELOFF, Circuit Judge.

Judgment was entered against Texaco upon a jury verdict in the Eastern District of South Carolina for fire damage to plaintiff Burriss’ feed mill. Jurisdiction was based on diversity of citizenship.

For more than thirty years Texaco has held a lease from the Carolina & Northwestern Railway Company on certain land in Anderson, South Carolina, used for the storage and distribution of gasoline.
