This is an appeal by Lena Barton and Nationwide Insurance Company, appellants, defendants below, hereinafter sometimes referred to individually as Barton of Insurance Company, from a ¡final order of the Circuit .Court of Randolph County entered June 4, 1970, denying appellants’ motion for a new trial and to set aside a judgment against them dated August 29, 1969, upon a motion for judgment on the pleadings or, in the alternative, for summary judgment filed by Otis Mooney and Jewell Ethel Mooney, appellees, plaintiffs below, hereinafter sometimes referred to as Mooney.
