INTRODUCTION
The above-entitled matter came on for hearing before the undersigned United States District Judge on April 24, 1998, pursuant to a motion to dismiss by Defendants Ancor Communications, Inc., Lee B. Lewis, and Dale Showers. This is a class action to recover damages allegedly suffered as a result of Defendants’ violations of Section 10(b) of the Securities Exchange Act of 1934 (the “Exchange Act”) and SEC Rule 10b-5 promulgated thereunder.
