MEMORANDUM OPINION AND ORDER

I. Introduction

Marc A. Pergament, as chapter 7 trustee (“Trustee”) of the estate of April Bein-hauer (“debtor”), filed a motion pursuant to 11 U.S.C. § 707(b)(1)1 to dismiss the debtor’s bankruptcy case as an abuse of the provisions of chapter 7 based upon the “totality of the circumstances” under § 707(b)(3)(B) and requested that the Court order debtor’s counsel to reimburse the Trustee for costs, including attorney’s fees, in prosecuting the Motion pursuant to § 707(b)(4) (the “Motion”).
