This ACTION was tried at the December Term, 1892, of the Superior Court of Guilford County, before Connor, J., and a jury. Tiie plaintiff’s .complaint alleged— 1. That on or about the 30th dajr of April, 1891, in the city of Greensboro, the defendant applied to plaintiff to purchase for him fifteen shares of the stock of the Greensboro Coal and Mining Company, a corporation organized under the laws of North Carolina, with its principal office in said city; and at the same time requested the plaintff to advance the money necessary for the purchase of said stock, to-wit, the sum of five hundred…

after .stating the facts: It will be seen that the plaintiff alleges a purchase of certain stock by him for defendant, and at his request; the payment by plaintiff of $500 for said stock at the request of defendant, the issue of the same to defendant and its acceptance by defendant, and his promise to pay plaintiff the sum advanced by him upon the issue of said stock to defendant', and the refusal to pay plaintiff the sum so advanced.
