MEMORANDUM ORDER GRANTING IN PART AND DENYING IN PART PLAINTIFF’S MOTION FOR SUMMARY JUDGMENT

The above-entitled matter came on for hearing before the undersigned on the 26th day of January, 1995 on plaintiffs motion for an order granting summary judgment.
