OPINION

BACA, Justice.

We accepted certification of this appeal from the court of appeals pursuant to NMSA 1978, Section 34-5-14 (Repl. Pamp. 1990) to clarify the law of duress as a defense to the crime of felon in possession of a firearm. We also consider the other two issues raised in this appeal: Whether the trial court improperly denied defendant’s motion to discharge the jury, and whether the use of the same prior felony to prove the crime of felon in possession of a firearm and defendant’s status as a habitual offender violates double jeopardy.
