KNIGHT, Justice.
The purpose of the original bill was to require, by appropriate decree, the removal of a certain one-story brick building from and off Washington street, in the city of Russell-ville, Ala., upon the theory that said street was one of the public streets of said city, and that the construction and maintenance'of said building was an unauthorized obstruction of said street, creating thereby a public nuisance, injuriously affecting the rights of the general public, and particularly of the complainants.
