The plaintiff, Vincent Carcello (“Carcello”), brings this action for wrongful discharge against the defendant, TJX Companies, Inc., Hit or Miss (“TJX”), alleging violation of the Age Discrimination in Employment Act, 29 U.S.C.A. §§ 621-634 (West 1998) (“ADEA”), breach of implied contract of employment, breach of duty to act in good faith, and negligent misrepresentation.
