MEMORANDUM OPINION AND ORDER
KATZ, District Judge.
This matter is before the Court on Defendant’s motion for relief from judgment, Plaintiffs opposition and Defendant’s reply thereto. This Court has jurisdiction pursuant to 28 U.S.C. § 1331. For the reasons stated below, the Court finds the motion not well taken and denies the same.
Background
