The case underlying this appeal arose in the wake of the failed prosecution of Nicolás Nogueras-Cartagena (Nogueras), a prominent politician who had been indicted on charges relating to tax fraud and violations of the Ethics in Government Act. Following the dismissal of the criminal case, Nogueras sought to recover money damages against the federal government, the prosecutors, and the two federal agents who had spearheaded the investigation.
