In a proceeding pursuant to CPLR article 78 to review a determination of the Town of Poughkeepsie Zoning Board of Appeals, dated November 15, 2006, and revised findings dated December 11, 2006, which, after a hearing, granted the application of Geraldine Dooley-Rifenburgh for an area variance, the petitioners appeal from an order and judg*794ment (one paper) of the Supreme Court, Dutchess County (Brands, J.), dated April 3, 2007, which granted the motion of the Town of Poughkeepsie Zoning Board of Appeals to dismiss the proceeding, and, in effect, denied the petition and dismissed the proceeding.
