An information was filed in the county court of Ottawa county, charging the defendant with the unlawful possession of intoxicating liquor. He plead guilty and was sentenced to pay a fine of $50, and serve 30 days in jail. From this judgment and sentence he has appealed.

The state has filed a motion to dismiss the appeal, and no response has been filed thereto. Counsel for defendant having filed a brief upon the merits, we have decided to pass upon the merits of the case.
