Affirming.

The question involved on this appeal is.the amount of commissions due the sheriff for collecting the school tax of Ballard county. The officer claims that he is entitled to ten per cent commission on the first five thousand dollars and four per cent on the remainder, whereas the fiscal court held that the county tax and the county school tax constituted one fund, and allowed the sheriff commissions of ten per cent on the first five thousand dollars and four per cent on the remainder of the aggregate amount collected by him.
