Harry B. Hulings, a resident of Washington county, died intestate in September, 1922, leaving an estate of some $30,000. Thereupon a woman known as Maud Hulings was appointed administratrix of his estate on the supposition that she was the common-law widow of the decedent. Some time later one of the defendants, to be known herein as Lulu Hulings, appeared, and represented herself as the widow of the decedent, as a result of which the first-appointed administratrix resigned her trust, and the Central National Bank of Marietta was appointed administrator de bonis non of. the estate.
