This is an action for libel. Defendants' joint demurrer to the first amended petition, on the ground that the "petition fails to state facts sufficient to constitute a cause of action against defendants," was sustained. Plaintiff refused to plead further and thereupon judgment was entered in favor of defendants. [1] The petition alleged damages, actual and punitive, in an aggregate amount of $40,000 wherefore plaintiff's appeal from the judgment of the circuit court (of the City of St. Louis) comes here.
