John McMahon (McMahon) and the Rural Pennington County Tax Association appeal a judgment dismissing their action against Jack Dier (Dier) for the recovery of certain royalties and settlement proceeds he re ceived in connection with the development of a computer program. We affirm.

FACTS

In 1979, Dier was employed by Pennington County South Dakota as its county highway superintendent.
